Description

Under Article 40 of the Labor Code of the Philippines, non-resident of aliens are allowed to work in the Philippines provided that there must first be “determination of the non-availability of persons in the Philippines who are competent, able and willing at the time of application to perform the services for which the alien is desired. However in the light of the liberalization process in trade in services, particularly under Mode 4 of Movement of Natural Persons, the purposes by which the test was created need to be revisited and reevaluated.
